Usuwanie (niszczenie) znaków geodezyjnych i znaków granicznych jest niezgodne z prawem. Prawo geodezyjne i kartograficzne kto wbrew przepisom art. 15 niszczy, uszkadza, przemieszcza znaki geodezyjne, grawimetryczne lub magnetyczne i urządzenia zabezpieczające te znaki oraz budowle triangulacyjne, a także nie zawiadamia właściwych organów o zniszczeniu, uszkodzeniu lub przemieszczeniu znaków geodezyjnych, grawimetrycznych lub magnetycznych, urządzeń zabezpieczających te znaki oraz budowli triangulacyjnych, – podlega karze grzywny. Orzekanie następuje na podstawie przepisów o postępowaniu w sprawach o wykroczenia. Niszczenie znaków geodezyjnych (znaków z trwałego materiału, określających położenie osnowy geodezyjnej) jest zatem wykroczeniem. Zgodnie z art. 24 § 1 ustawy z dnia 20 maja 1971 r. Kodeks wykroczeń grzywnę wymierza się w wysokości od 20 do 5 000 złotych, chyba że ustawa stanowi inaczej. Niszczenie (usuwanie) znaków granicznych uregulowane zostało w art. 277 ustawy z dnia 6 czerwca 1997 r. Kodeks Karny, kto znaki graniczne niszczy, uszkadza, usuwa, przesuwa lub czyni niewidocznymi albo fałszywie wystawia, podlega grzywnie, karze ograniczenia wolności albo pozbawienia wolności do lat 2. Zatem usuwanie (niszczenie) stałych znaków granicznych (określających przebieg granic działek) jest już przestępstwem.
